Ce mardi 24 mai à 12h30, une délégation de la campagne In My Name s’est rendue à la commission pétitions du parlement fédéral. L’objectif de cette commission, qui avait expressément modifié son ordre du jour pour In My Name, était de déterminer la recevabilité de la proposition de loi citoyenne portant sur la régularisation des personnes sans-papiers. Alors qu’il n’y a plus de problèmes techniques, la commission avance des problèmes de manque de personnel et demandent aux citoyen.ne.s de pallier, une fois de plus, au manque de moyens mis en place.
Pour rappel, la campagne In My Name avait récolté les 25 000 signatures nécessaires au dépôt d’une loi citoyenne. Elle risquait cependant de se voir refuser l’accès au parlement pour des raisons techniques. Suite à cet événement, les pétitionnaires avaient mis la pression sur la commission et obtenu que celle-ci traite, au plus vite, leur dossier afin qu’il.elle.s puissent être entendu.e.s au parlement fédéral.
Entre-temps, les problèmes techniques de vérification des doublons qui étaient évoqués ont été résolus par l’administration. En effet, le parlement a accès à l’ensemble des noms ayant signé en ligne et l’administration à proposé une méthode de vérification à la commission pétition. Pourtant, les conclusions de la commission ne permettent toujours pas aux pétitionnaires d’accéder au parlement fédéral. Les raisons de ce refus proviennent d’une divergence d’interprétation de la loi et le manque de moyens humains au sein de l’administration. La commission avance que cela lui prendrait trop de temps de vérifier la conformité des signatures.
Ainsi, la commission a décidé de renvoyer la balle à la conférence des présidents afin qu’ils s’accordent à mettre In My Name à l’ordre du jour de la commission intérieure. Cela leur permet d’ignorer le débats sur la simultanéité des procédures et d’éviter le comptage des signatures. En cas de refus de la conférence des présidents, le débat sera de nouveau renvoyé à la commission pétition qui devra statuer sur la recevabilité de cette proposition de loi.
Peu importe l’issue, les pétitionnaires refusent que leurs droits de proposition de loi citoyenne soient bafoués, faute de ressources humaines suffisantes au sein de l’administration compétente. S’il manque des ressources humaines pour garantir ce droit, alors les politiques doivent engager du personnel supplémentaire et non pas empêcher la participation citoyenne. Bien que cela ne relève pas de notre responsabilité, nous, citoyen.ne.s, avons accepté de pallier au manque de moyens humains en acceptant d’encoder nous-mêmes (manuellement) les signatures de personnes figurant sur la liste électronique. Malgré cela, la commission n’a pas voulu statuer positivement pour le moment.
Nous avions rempli une première fois notre contrat en déposant 35 000 signatures et sommes prê.te.s à faire le travail du parlement fédéral en encodant nous-mêmes ces signatures. Il est inconcevable que le droit d’accès de cette pétition nous soit encore refusé après toutes ces démarches.
Nous demandons à la conférence des présidents de permettre une audition, comme prévu par la loi de 2019 relative aux pétitions adressées à la chambre, après les vacances parlementaires.

PARLEMENT STELT ONS GEDULD OP DE PROEF
Tijdens de zitting van de Commissie Verzoekschriften van de Kamer gisterenmiddag kwam het niet tot een uitspraak over de 35.000 handtekeningen die In My Name verzamelde voor een transparanter regularisatiebeleid. In een bureaucratische estafette die de geloofwaardig-heid van het parlement ondergraaft, besliste de commissie de hete aardappel door te spelen naar de Conferentie van Voorzitters, komende woensdag 1 juni.
Sinds 2019 kunnen Belgische burgers zelf wetsvoorstellen indienen bij de Kamer van Volksvertegen-woordigers. Voorstellen die 25.000 handtekeningen weten op te halen, worden besproken in het parlement. Met deze burgerparticipatieve regeling hoopt de overheid de kloof met de burger te verkleinen.
Vorige week haalde In My Name als eerste ongebonden burgerinitiatief in België de vereiste hoge drempel met een burgerwetsvoorstel voor heldere, humane regularisatiecriteria. Het voorstel wil de huidige willekeur uitbannen voor al wie in België een wettig verblijf aanvraagt. Maandenlang hebben wij als burgers met en zonder papieren, met de steun van zowat 120 organisaties, handtekeningen verzameld. Nadat zovele ondertekenaars problemen ondervonden met het digitale platform van de Kamer, besloten we ook handtekeningen op papier te verzamelen. Uiteindelijk klokte onze campagne af op maar liefst 35.000 handtekeningen.
Groot was dan ook onze verontwaardiging toen bleek dat de bevoegde diensten van de Kamer de handtekeningen niet wilden aanvaarden. Door technische redenen en een gebrek aan middelen, zouden ze in de onmogelijkheid verkeren om de 13.500 digitale en 21.500 papieren handtekeningen te vergelijken en eventuele dubbels te detecteren. Nochtans zijn beide methodes voorzien in een koninklijk besluit van 2 mei 2019 én was de voorzitster van de Kamer er al geruime tijd van op de hoogte dat we de beide combineerden. Toch ontstond er plots discussie over de interpretatie van dat koninklijk besluit.
Tegen deze bureaucratische scherts hebben wij ons democratisch recht de jongste dagen actief bevochten bij de Commissie Verzoekschriften. Met de steun van enkele leden van de 17-koppige commissie kregen we deze kwestie op de agenda van de geplande zitting van gisteren, die live werd bijgewoond door een delegatie van In My Name. In de zitting werd onder meer geopperd dat wij als vrijwilligers de Kamer zouden helpen om de handtekeningen om te zetten in een compatibel format. Niet alleen vervulden we ruimschoots onze burgerplicht door 35.000 handtekeningen te verzamelen en in te dienen. Nu worden we ook nog bereid gevonden om onbetaald het werk van de administratie te doen en die handtekeningen zelf te stroomlijnen. Hoeveel ‘participatiever’ kan een democratie nog worden?
Tot een beslissing kwam het echter niet. De kamercommissie slaagde er niet in een knoop door te hakken en schuift de kwestie nu door naar de Conferentie van voorzitters, die zich er in de komende dagen over zal buigen. De Conferentie van voorzitters is bij machte het burgerwetsvoorstel van In My Name zonder telling van de handtekeningen op de agenda te plaatsen van het parlement. Besluit ze dit niet te doen, dan komt ons voorstel weer op de tafel van de Commissie Verzoekschriften terecht.
Door ons van stuurboord naar bakboord te sturen, stellen de volksvertegenwoordigers alleen het onvermijdelijke uit. Wij zijn ervan overtuigd dat het debat over een menswaardiger regularisatiebeleid uiteindelijk zal moeten plaatsvinden – niet achter de gesloten deuren van de Conferentie van voorzitters, maar in een plenaire zitting. Wij roepen de bevoegde politici dan ook op om ons petitierecht kost wat kost te vrijwaren en het niet te laten sneuvelen op interne technische, administratieve of financiële struikelblokken.
Indien de 35.000 handtekeningen voor In My Name niet ontvankelijk verklaard worden, dreigt het burgerinitiatief dat met veel bravoure werd gepromoot, uiteindelijk een nog grotere kloof te slaan tussen burgers en de overheid. En dan dreigen niet-erkende medeburgers nog maar eens te worden bevestigd in de ervaring dat in ons land geen enkele juridische of wettelijke procedure bescherming biedt tegen politieke willekeur.

BELGIAN PARLIAMENT PUSHES THE LIMITS OF OUR PATIENCE
Yesterday’s session of the Committee of Petitions of the Belgian Federal Chamber of Representatives did not lead to a ruling on the 35.000 signatures gathered by In My Name, a national campaign advocating for a more transparent regularization policy. In a bureaucratic relay race that threatens to undermine the parliament’s credibility, the Committee has now passed on the hot potato to the Conference of Presidents, next Wednesday June 1st.
Since 2019, Belgian citizens can submit legislative proposals to the Chamber of Representatives. Proposals that manage to gather 25,000 signatures are discussed in parliament. With this new instrument of citizen participation, the Belgian government hopes to bridge the gap between politicians and voters.
Last week, In My Name became the first unfettered citizens’ initiative in Belgium to meet the required high threshold with a citizens’ law proposal for clear, humane regularisation criteria. The proposal aims to put a stop to the chronic arbitrariness affecting people applying for legal residence in Belgium. As a coalition of recognised and unrecognised co-citizens, supported by over 120 organisations, for months we have been collecting signatures. Since innumerable signatories encountered problems accessing the Chamber’s digital petition platform, we decided to collect signatures on paper as well. Ultimately, our campaign managed to generate no less than 35,000 signatures.
Imagine our disappointment when it turned out that the competent parliament services did not want to accept the signatures. Citing technical reasons and a lack of resources, they claimed not to be in a capacity to compare the 13,500 digital and 21,500 paper signatures and to check for potential duplicates. However, both methods are deemed valid in the Royal Decree of 2 May 2019, regarding the right to petition. Moreover, the chairwoman of the Chamber had long been made aware of our combining the two. Nevertheless, we suddenly found ourselves in an unimaginable discussion on how to interpret the royal decree in question.
Faced with this bureaucratic farce, the past few days, we have been actively defending our democratic right, urging the Committee of Petitions of the Chamber of Representatives to table the matter in yesterday’s scheduled session. With the support of several of the 17 Commission members, we managed to put the issue high on the agenda. Yesterday, a delegation of In My Name attended the session, during which it was a.o. suggested that we, as volunteers, help the Chamber encode the signatures into a compatible format. Not only did we already amply fulfill our civic duty by collecting and submitting 35,000 signatures. But now we also find ourselves having to sync those signatures ourselves, doing the administration’s work for free. How much more ‘participatory’ can democracy get?
However, the Committee of Petitions did not reach a conclusion. Failing to make a joint decision, they decided to pass the buck to the Conference of Presidents, which is to consider the matter in the coming days. The Conference of Presidents has the power to put In My Name’s citizens’ law proposal on the agenda of the federal parliament. In case they decline to do so, our proposal will once again end up on the table of the Committee of Petitions.
By sending us from pillar to post, the members of parliament are only delaying the inevitable. We are convinced that a debate on a more just and humane regularisation policy will eventually have to take place – not behind the closed doors of the Conference of Presidents, but in a plenary session. We therefore call on the politicians responsible to safeguard our right to petition at all costs and not to sacrifice it due to internal technical, administrative or financial obstacles.
If the 35,000 signatures for In My Name are not deemed admissible, the much-touted mechanism of the citizen’s initiative will only serve to widen the yawning gap between citizens and the government. And unrecognized co-citizens will once again see their suspicions confirmed that in Belgium not a single legal procedure or decree offers protection against political arbitrariness.
